Indefinite leave to remain or enter (also known as settlement) as a Spouse, Civil Partner or Unmarried Partner is for those individuals who have already completed the relevant period under the relevant routes, i.e., either 5 years (60 months) or 10 years (120 months) in the UK as the partner or spouse or unmarried partner of a British citizen or settled person. They may also need to meet the financial or adequate maintenance requirements under Appendix FM to the Immigration Rules.

Unless some exemptions apply, they will also need to meet the relevant English Language and life in the UK requirements by passing both tests.

If applying for indefinite leave to enter or remain as an Adult Dependent Relative or Child, they will need to demonstrate that they will be adequately maintained, accommodated, and cared for without recourse to any public funds. There is no English language requirement, and it is not necessary to pass the Life in the UK test for adults aged 65 or over and children under the age of 18.

If you believe that you are eligible to apply for settlement under any of the above routes, please feel free to contact us at hi@kb-law.co.uk, or Book an Appointment and we will be more than happy to legally assist you.
